seat.md

Insofar this projects maintains rights and obligations, it is seated in Pumpelhausen, Mightington, Frederickshaven.

by seat, do you mean the "philosophical foundations" underpinning our ethic? If so, I am certainly not opposed as it could certainly help strengthen and justify our overall code. However, it is at least somewhat orthoganal and perhaps should instead be including in a different repository or perhaps a link?

Maybe a section to supporting evidence somewhere?

Well, I was asking myself where to donate the https://eka.la domain to and other rights.

As for enforcement action the project might be holder of obligations, too, and express will through its organs.

For enforcement of all these, we need a "seat" or "domicile".

I thought about this because of "Accountability", it is nothing without enforcement. But strictly speaking the legal domicile of the project is otherwise tangential to its ethical substrate formation.

While we may not be able to avoid declaring a "domecile" as you put it, in terms of the legal juristiction which will hold us accountable afk, at least in terms of the ethos (individual sovereignty), the rightful "enforcer" of authority in spirit is the "project owner(s)" who found a given project and whoever they so choose to delegate that authority to from there.

If they choose to adopt our Ethic then I should hope they dole out that efforcement in more of a remediating and conceliatory fashion, delegating those decisions more and more as the project scales, but if they do not, at least denizens of the project can point back to the tenet which is violated as a clear sign of "abuse of power".

I hope to actually outline a reasonable remidiation procedure and to some lesser extent, tenets of moderation (which basically defer to the original definition of a moderator, think a moderator of an in person debate, for example) to guide these decisions in line with the Ethic.

Still, I haven't considered it because it's so early, but we may benefit from forming some kind of legal entity or non-profit in some territory.

Eventually yes, as holder of "civil rights and obligations". As side effect, it also portrays "seriousness".

And I also otherwise agree with the analysis in your reply.

We could either close this issue or leave it open for later reference.

nrdxp commented 5 months ago

let's leave it open for now. We can consider it closed when we take the action to form the legal entity in question.

yeah, I think the question who own the domain can be solved at a later stage.
