I'm wondering if we should consider bootlegs as freeware... I'm unsure of any ramification of distributing these kinds of games??

http://retroachievements.org/game/5784 (~unlicenenced~ Aladdin (nes) is also a bootleg afaik.

Perhaps bootlegs should all be listed as unlicensed and homebrews need to be entirely freeware. Anyone have more thoughts or knowledge on this?

Due to the nature of the retrogames and how retrogramers "practice" this hobby, the RetroAchievements project runs a great legal risk of being tied to piracy. So my suggestion is: "When in doubt, do not link."
