cannot create course if 2nd level in structure is empty #103

It is not possible to create a course if the second level is empty in the course structure, but the third level is not: Error Message: "Fehlende Rechte" kursstruktur

I modified some code and course creation works now. Can you please review the course creation?

course creation is now possible, please transfer patch to live-system before school starts.
