kioskmode bug?

What steps will reproduce the problem?
1. Enable kioskmode in mame.cfg 
2. launch mame
3. press escape

What is the expected output? What do you see instead?
Exits to the command prompt

What version of the product are you using? On what operating system?
1.4 

Please provide any additional information below.
It seems that the only way to make it work is:

- Launch mame
- Select a game
- Exit the game
- Now kiosk mode seems to be activated as esc doesnt seem to exit the menu 
anymore
