As far as I am concerned, you can do whatever you want with it. However, as you stated, the original version is licensed under BSD. I can't answer for certain regarding any legalities, but since this one is derived from the original elFinder.Net code, it is possible that means you may have to retain the copyright notice in any redistribution of your source code. If you are worried about it, perhaps try to contact Yevhen Noskov here: https://github.com/EvgenNoskov/Elfinder.NET.
I will address the issue of missing license info at some point in the future when I've had time to look into it more. I can't promise when that will be.

Can you please specify under which license is your code released (MIT, BSD, Apache, ...)? Please add this information to README file. Original elFinder is released under BSD license, is yours as well?
