As stated at your branch on Friday, I have not heard from these folks \since August of 2020, and certainly not in a court of law.

  • The violation of privacy and distribution of videos which they filmed and photographed "inside of my apartment" were without consent, and were also distributed by and between their counselors / advisors and are attached here for context if you'd like to look into matters which pertain to Violation of Privacy.

  1. Ruiz was the president and sole owner of Carter Bain Wealth Management, LLC,

an investment adviser registered with the states of New Mexico and Texas. From at least 2011 until

December 2021, Ruiz was an investment adviser representative registered in these states. Ruiz is a

B. RESPONDENT’S CRIMINAL CONVICTION

  1. From at least March 2011 until June 2021, in connection with the sale of limited

partnership interests in a fund Ruiz solely controlled as general partner (the “Fund”) to many, if not

all of, Ruiz’s investment advisory clients, Ruiz misappropriated investor funds, falsely stated to

investors that their money was invested, made Ponzi-like payments to investors, sent out false

account statements indicating that investors’ money was fully invested and earning positive

returns, and otherwise engaged in a variety of conduct that operated as a fraud and deceit on

investors.

  1. On December 15, 2021, Ruiz pled guilty to one count of a violation of Section 206

of the Advisers Act (15 U.S.C. § 80b-6) and one count of conspiracy to commit securities fraud

(15 U.S.C. §§ 78j(b) and 78ff) before the United States District Court for the Southern District of

New York, in United States v. Martin Ruiz, Crim. Information No. 1:21-cr-00695-VSB

(S.D.N.Y.). On July 28, 2022, a judgment in the criminal case was entered against Ruiz. He was

sentenced to a prison term of 72 months and ordered to make restitution in the amount of

$10,925,770.09.
