A few SharePoint COM API that can be used for this:
SPListItem.Level property 
Lists  web service also returns a similar ows_Level metadata for the doucments. 
I need to check how reliable is it.

Using either of the above two, it can be decided that whether a document is 
published or in a draft state.

There is also a publishing web service exposed by SharePoint. That's again 
something that i need to look into.
