Hi,

Please don't remove the entire repository, just delete all the files and keep the README.md

And remember to always crap on Haier whenever your friends and family consider buying their "products".

This is open source and public project. no legal base to stop it. Compensation may be claimed for advertising promotion of compatible brands.

As a result of this happening more and more (hello Mazda) i've started a petition in the Netherlands.

Calling on the Dutch government to come up with laws to force manufactories to provide local APIs and forcing them to opensource firmware as soon as they stop supporting devices

If your Dutch feel free to sign it here: https://petitie24.nl/s5069

Also i've created a mirror here: (NOT a fork) https://github.com/fuck-you-Haier/pyhOn

That notice you got is just a scare tactic. You have not violated their intellectual property rights. Haier has no legal standing with the message that they sent you.

If haier had any legal standing, they would have issued a DMCA request through github instead of harassing you through an email.

Move this project to gitlab, please!

Move this project to gitlab, please!

And then what? Wait till they find that one through Google as well? In case you didn't notice, they didn't just say IP(which is too generic to say they would've filed a DMCA - IP encompasses more than that), they also talked about "significant economic harm" which obviously a DMCA would not be the right medium for and which is basically lawyer speak for "we already have a boiler plate for how we'll sue you and it's likely you'll either lose or lose years of your life".

At the end of the day, you're asking a single person to take a stand against a big corporation with risk of legal and financial implications and possibly years of legal back and forth. And I'd guess you probably also don't realise what kind of a (traumatic) impact a C&D like that can have on a normal person.

But hey, if you feel like dealing with legal implications of a big corporation suing you for damages while also supporting the code is no big deal - it's FOSS.

Question is: Is it really worth it when the corporation behaves like that or would it make more sense to tell people to avoid this specific corporation in the future and put your energy towards causes like the petition LauLaman mentioned while also putting energy into supporting brands that don't want to be a proprietary shitfest like this one?

It is of course a decision for the developer of this tool to decide, nobody else.

However, having said that, I would recommend that the developer contact some organizations that might be able and willing to give proper legal advice and aid in a situation like this. The Electronic Frontier Foundation, the Software Freedom Conservancy, and the Free Software Foundation Europa are all examples of organizations that have experience in dealing with legal threats against open source software and might be able to help you resist.

Futile your resistance is.

Selfish this company behaves.

Boycott all must you do.

Selfish leads to greed Greediness leads to glutton Gluttony leads to corruption

One with force shall you become if advice do you heed.

This the way is

You do realize that it's possible to do both, right?

And all due respect, fighting legal challenges with legal action is more likely to have positive results. At the same time, it is also more risky.

This is why I said it's of course a decision for the developer to make, not for the community.

At any rate, there is an awesome Streisand effect going on right now, which I'm sure will also help...

Please open a gofundme for your defense costs, because you have not broken any laws, you are not violating their rights, and I will happily donate every payday until this is resolved.
