As you saw, this was something that we discussed last year, in #9574.

At the time, we had opted not to add such a checkbox to the commenting system:

There are a few valid ways to be transparent and compliant about cookies that a site uses to enable its features, like comment form auto complete. The way we chose is to include information about the cookies we use (including the comment cookies) in our cookie policy which you can read here. I don't believe our position has changed on the matter, but I'll ask one of our counsels to give us some more background on this.

alternatively if you can suggest a plugin which solves the issue I would love to hear about it.

I am afraid I am not familiar enough with Social Login plugins to be of much help here. You may want to check Disqus and see if they have the consent options you are looking for here. Until then, the easiest option may be for you to deactivate Jetpack's Comments feature and rely on WordPress Core's commenting system instead.

I did, and will get back to you here as soon as I have more info!

I can allow users to subscribe (email opt in) for updates about new content. Trouble is, that form is non-compliant too.

The subscription options can also be used at the bottom of the regular comment form, so you could use them even if you do not use Jetpack's own commenting feature.
