Siphone name used by iTalk #149

Is Siphone a trademark or copyrighted? A new app on appstore called siphon just 
released from 
iTalk of http://www.vnet-corp.com/
If copyrighted, contact this vendor.

Siphon was used by open source project on Sourceforge before december 2007.
In december 2007, I contact them and they agreed I used the name because they 
had to
give up their project.
So first arrive, first use.

But on AppStore the name is SipPhone, and it's different from Siphon.
Moreover sipphone is the name of Gizmo5 project.

In all cases, vnet-corp is "bad" company, they use GPL code (pjsip and mine) 
and they
didn't release their code, and now they use a name equivalent to my SW.

I will prefer Apple accept my app rather I fight with them.
