A few notes. In TBCC freezing trap benefits from spell pen. In TBCC Explosive traps benefit from AP on the explosion, and also benefit from spell crit on explosion. In TBCC explosive traps do not benefit from spell hit. In WotLKC beta explosive traps explosion benefits from ranged crit and AP. Explosive trap ticks benefit from RAP and also ranged crit if glyphed. I'm not if any hit affects traps in WotLKC beta. It is not clear to me what the 4.2 trap patch note refers to exactly.

Back in the day, say 3.3.5a because that's what we're discussing. Traps didn't benefit from spellpen, or any of the stats mentioned in the patchnotes for cata. They aknowledged that their intention was always that the traps inherited these stats but because of technology limitations, they couldn't until cata.
Blizzard decided that even though traps didn't benefit from spellpen in TBC, they ought to in TBCC - or atleast they didn't look at it. It's up to them to decide if they wanna fix that old bug, or keep things exactly like it was in 3.3.5a
For what it's worth, when it was fixed in June 2011 it was even written in the patch notes that it was intended to be that way from the get go.

In the #SomeChanges post it is written that they want to preserve the familiarity of class designs and that this familiarity is easily damaged. Will be up to Blizzard whether they want to preserve how the class is currently designed in TBCC in regards to spell penetration and traps or how it was back in 2010 when the only reason for it not to be designed in the way it currently is in TBCC were technical limitations which, as TBCC shows, are not an issue anymore. Cause the whole class will have to be played drastically different in arena if trap doesn't scale with spell penetration as every other magical ability does in the game.
