Where a new election is required after the countermanding or abandonment of a poll due to a candidate’s death, you are required by law to select a new day for the poll, and this must fall between 21 and 28 working days after the publication of the new notice of election. If a party candidate has died, you must, by law, publish a new notice of election on the first working day that occurs after a period of seven calendar days starting on the day that you have received proof of death. If an independent candidate has died and a new election is required, you must, by law, publish a new notice of election on the first working day that occurs after a period of seven calendar days starting on the day of the original election.
Unlike in England & Wales, Scottish uncontested candidates are not elected until polling day. On Scottish uncontested ballots we want to change the text to read, at least: "will be automatically declared the winner"
Might need some pondering on this though. Will see what the EC say.
