The feedback is based on the feedback order attribute. The first level (1, 2, 3, 4...) are scores DEs and also work as sections. Since they are only DEs to store the scores, they are not mandatory nor they have a "critical" status. So in the Non-critical tree, they are displayed even if they don't have non-critical children.
In the following example the section D is present in both tabs (critical and non-critical) even when that particular section only have critical questions under it. This is confusing because you will be expecting to see the non-critical questions that conform the 100%.

I think it would be better to display the score DE (first level) only if it has critical or non-critical questions under it. In the example, the section D should be visible ony in the "All" and "Critical" tabs, but hidden in the "Non-critical" tab.
