I'm going to have to assume the latter is correct, especially with the ambiguity of the WoWhead comment not knowing if it was just temporary (which it seems it was, based on the other thread).
At 8:15, the rogue immunes Death Grip because he is Incapacitated (Repentance).
The only other thing I could find remotely resembling this was https://www.youtube.com/watch?v=mCCySuuk_hk&t=24m40s but that isn't adequate evidence because the rogue was also rooted (pin), which would have also caused it to be immuned.

You can Death Grip stunned/incapacitated targets here.
I'm fairly sure this shouldn't be possible. I have a couple conflicting sources.
