Currently, the availabilityelement is defined but unused in the public charters. Since it is a standard header element, what should we put in it when transforming the files? Would the Terms of Use serve?

Yes, terms of use are a good general solution. For IllUrk we will have to distinguish between metadata (CC-BY-NC) and images (individual).
