exclude only when files exist

What steps will reproduce the problem?
1. add path under exclude to .conf file
2. delete matching files from that path
3. run tests

What is the expected output? What do you see instead?
tests should run if excluded files do not exist (the point in excluding them). 
instead the tests fail to run

What version of the product are you using? On what operating system?
1.3.3d on Windows

Please provide any additional information below.
