I have the same exact issue, also under 10.8.2
By doing a chown -R $USER on the Library in /usr/local/ I was able to install it and seems to be working now.
Try chowning, or removing the previous Homebrew library.
This worked for me:
cd /usr/local
# Moving old stuff out of the way.
sudo mv -v Library Library.old
# Now run Homebrew install script again.
Same exact issue and moving the library seems to have fixed it for me as well.

This mostly happens if you are using brew with multiple users. If that's the case, I think you're better of doing chmod -R 775 Library
. This way, all users within the group will be able to install and upgrade packages.
