Notification of Copyright Violation #17

Closed GoogleCodeExporter closed 9 years ago

Fab,

You claim that others are selling your 'free' package and making a profit off
of your hard work but you fail to acknowledge that you are illegally using font
code developed by Kaonohi Kai and XenoType Technologies. I suspect you are the
same person I've emailed under a different name on a different web site. You
are hereby notified that you are in violation of copyright infringement. The
tables you provide in the core system fonts (arialuni.ttf, Helvetica and
Helvetica Bold) are copied directly from my commercial retail package (Khmer
Language Kit). Previously, you were using my font outlines AND the tables. I
see that you have chosen to replace my outlines to obscure the fact that you
are using my font code illegally but the fact remains that that code was
created by me and is wholly owned by me. Your use of it is a violation of the
original software license that accompanied the font you stole it from. A
complaint has been filed with Google under DMCA. Remove access to all such
fonts immediately or remove the font code within the individual fonts.

For your information. I do not claim anything, and if people sale this
packages, I do not have any knowledge of.
I do not make this for the money. I never claim anywhere any hard work on my
side.
I only share some knowledge for iPhone khmer community.
I do not run other web site. I'm busy enough in my life.
I never received email so far from anybody concerning this matters.

For your information, the font was found on internet on another web site, for
Mac OS X. I had no knowledge what so ever that this font was commercial.
Now that I receive your notification, I then remove the font from this web site.

Could you please inform me of the so called others web sites ? As I plan to try
to find other fonts (free), I would not like to include another copyrighted
font from your company without knowing.

First, thank you for responding so quickly. Second, please accept my apologies
if you are not the same person I have dealt with in the past on other websites
- it is not always possible to tell who's really behind any given website or
project. To my knowledge, there are no free Khmer fonts that will work with iOS
or OS X other than ones that I have created and ones that steal my code. There
are perhaps a half dozen fonts that claim to work properly with OS X and they
do, but they all use proprietary code that I developed. I cannot tell you which
fonts contain my code as they keep changing the names or the visual appearance
of the fonts but to date, they all are in violation. As I find out about them,
I request that they be removed.

For those people who would like to use their iPhone/iPod in Khmer, I understand
this desire but my fonts and the font code that makes them work took many
months to develop, I simply cannot afford to give them away. I am however open
to requests and other possible solutions including releasing the tables for
this type of project exclusively. To date, nobody has ever asked permission -
they simply steal.

sorry to interupt this matter, but as for your hard work (kaonohi) in
developing khmer font to be compatable with iOS or OS X, you should have a
right to claim for your copy right, and i do a gree. but as for long month the
iPhone user including me, they are very happy with the great technology that
allow them to see and write khmer on the iPhone, seem so be proud to us, but
before that us all never know that this font was be stolen or illegal using,
but we are very appreciate the one who was created them like fabkk2002, he
really give us a hope and so proud,
So as for my own idea ( 90% of khmer iphone user ) would like you to give him a
right to use your font because of your font very nice and so easy to use. and
other hand he package was use for free of charge so mean that he just give us a
chance to see khmer in iphone without charge any thing, so mean that he not
used your font for profite he use for knowledge and develop the khmer unity.

So as for this I hope you will understand and give us a chance to see your font
on our iDevice again.

in my opinion I think that Apple already paid to all owners of all fonts using
in iPhone and iPhone's owner can send the font of their iPhone to fabkk2002 to
add khmer font and send it back to them

I'm not sure you understand the situation savoklinux. First of all, Apple does
not include Khmer in any system font and that's because they haven't paid for
the rights or chosen an open-source font for that purpose. So no, you can't
just add whatever characters you want to the iPhone/iPod/iPad - you need to
make sure that the license for the font allows you to do that. Second, even if
a font contains the necessary characters for a given language (Khmer, Tamil,
whatever), there still needs to be code that tells the OS how to display the
characters correctly. As you know, with Khmer, you can't just type Khmer
characters and have it make sense. That's why most Khmer fonts don't work
correctly under Unicode (i.e., Mac OS X, the iPhone, etc.).

What i have developed are two different things - fonts AND the code to make
Khmer display correctly. Several websites are using my fonts AND my code, other
websites offer different fonts (sometimes open-source, sometimes not) WITH my
code. My fonts are not public domain, nor is my font code. I spent nearly two
years developing that code long before anybody else was even trying to. I'm
simply not in a position to just give it away. That's why I asked fabkk2002 to
remove my code (which would then make the fonts inoperable). He responded
quickly and I believe he understands my situation. We have been emailing each
other in an attempt to find a solution that works for everyone.

I am open to some suggestions from users like yourself but it can't just be me
giving away my intellectual property -- that defeats the purpose of having a
company that specializes in this type of thing for the past 20 years.
