Over the EU, 40 second interval is long enough(legal) with current packet size and DR5. However, over Japan, US, the datarate is DR4, so I don't know if the interval is long enough.
In the US, its not likely a problem because its not limited by dutycyle; experiments show that it can tx as often as it likes.
