Interpretation of CO2MPAS results #30

Dear Sir/Madam,

Recently I came across one of your research papers "Development & validation of a vehicle simulator for the introduction of WLTP in the European light duty vehicle CO2 certification process"-Applied Energy 226 (2018) 784-796.

I am slightly not clear about last few lines of the 2nd paragraph in the right side of page 11. It says "In case this random testing indicates an attempt by the OEM to exploit the CO2MPAS results for achieving lower CO2 emissions, a CO2 penalty is applied across the entire fleet of the OEM"

a. Could you explain more on the statement "exploiting the CO2MPAS results"? Does this mean OEMs cannot use CO2MPAS result to arrive at NEDC declared value? b. Can OEMs use any tolerance on the CO2MPAS simulated value to arrive at declared value? (my understanding is that 4% tolerance is permitted on the simulated value)

Please check paragraphs 3.2.7, 3.2.8 of Annex I.
