Comments page error

What steps will reproduce the problem?
1. when viewing an individual post I'm getting an error in the comments section 
(after the exiting comments and new comments box and post comments button):
Fatal error: Cannot redeclare constructor_comment_fields() (previously declared 
in /home/n86trco/public_html/wp-content/themes/constructor/comments.php:37) in 
/home/n86trco/public_html/wp-content/themes/constructor/comments.php on line 42

What version of the ... are you using?
1. Wordpress:3.0.3
2. Constructor:1.3.1
3. PHP:5.2.14
4. Browser:FF 3.6, IE 8 and Chrome
5. OS:Win7

Try to reinstall theme, or replace file comments.php from 
http://wordpress.org/extend/themes/constructor

I had already replaced the comments.php file, so i replaced everything. It 
fixed it, but I'm not sure which file was the problem. Thanks.

I'm not sure, I think it's deployment issue
