IdentifyPoly won't let the user draw a poly #90

I think this bug popped up as a result of Issue 81 "Comment Tool will also pop 
open Identify dialog when using OpenLayers 2.11".  Saul said that Identify tool 
not being deactivated in the tooglegroups.  

This bug just popped up at revision 197 if I go back to 193 it doesn't occur.

What happens is as soon as the user clicks on the map to draw a polygon, the 
identify dialog pops up.
