Vox populi 1.4.6 and earlier, when authority policies are completed, you should have ability to purchase in sequence Free companions, Foreign Legions, Mercenaries. It is possible to buy the Free companions and then upgrade them to Tercios. However, when Mercenaries should be purchasable, Free Companions drops out but the mercenaries do appear. In addition, if the free companions have not been upgrade to Tercios before this point, then the ability to upgrade the Free companions also disappears. Shoshone Art 01.zip
I think he means "Free Company",
and that he can't upgrade Free Companies to Tercio when Mercenaries are available. Note that you shouldn't be able to buy Free Companies once Foreign Legion is available.
Foreign Legion is bugged and not purchasable in 1.4.6, fixed in commit d408ac1ebd28571b11938f2c3e0cf97b3bcfd7db.
Free Company still upgrades into Tercios when Mercenaries are available in my test game:
