installing 2.40 via software update , doesnt actually update and keeps asking to install again ( from 2.3.2 ) #40

hi guys

when doing the software upgrade from 2.3.2 to 2.40 

i allow new software to download and install and it reboots etc 

it shows that its installing at the boot screen and i click next etc 

but when it starts up its still on 2.3.2 and the window apears asking me if i 
want to install 2.4.0 again

Which kernel do you use, custom or stock? if on Stock, did you flash the
latest one that comes with the rom?

previous updates via the gui have worked fine until this update 

am using a telstra htc one xl with no mods , but using holo launcher HD instead 
of nova as my preferred launcher
