The following was suggested:
“The Software is licensed on an "as is" basis and LMS makes no guarantees, representations or warranties respecting the Software, either expressed or implied, arising by law or otherwise, including but not limited to, effectiveness, completeness, accuracy or fitness for a particular purpose.
LMS shall not be liable in respect of any claim, demand or action, irrespective of the nature of the cause of the claim, demand or action alleging any loss, injury or damages, direct or indirect, which may result from the Licensee's use or possession of the Software. LMS shall not be liable in any way for loss of revenue or contracts, or any other consequential loss of any kind resulting from any defect in the Software.”
However, it was also suggested that the Open Data License would be sufficient. I have asked for clarification.
See issue #74
The decision was made to use the Open Data License. Email thread can be found on GCDocs: https://gcdocs.gc.ca/nrcan-rncan/llisapi.dll/link/64444593
