This PDF says that debt collection lawsuits are to be filed in any Justice court in Texas (Pg. 5, paragraph 1). If the debt collector files the debt collection lawsuit in a county where the borrower is not a resident, then it is the responsibility of the defendant to make a plea to transfer the court case to a suitable county court. The FDCPA 811(a) mandates the debt collector to file a lawsuit in a county where the borrower is resident. A violation of this opens up the debt collector to civil lawsuits.
