The scorpion doesn't apply it on it's own once it is already on a target and thus doesn't stack it up to the 5 stacks for maximum effect.

Tooltip says it can stack up to 5 times, pet does not recast until the first stack has worn off

Confirmed on internal. Should auto cast up to 5 stacks and maintain them.
