License violation of Core modules design (CC-ND) #1

The Core panels from VCV have the following license:

The visual design of the Core modules is copyright © 2019 VCV and licensed under CC BY-NC-ND 4.0. Commercial use and derivative works are not allowed.

Under c085620e5ac205ccaf4c048f3369280bf7044193 you have modified these files, which constitutes derivative work. This is not allowed by the license of these files. They must be recreated from scratch.

Thank you for your email Felipe.

These graphics were provided to me by Andrew Belt himself under licence. https://github.com/Rcomian/Rack/commit/ce6f144670f2ffa6c80e22402eb824ed31776404#diff-b335630551682c19a781afebcf4d07bf978fb1f8ac04c6bf87428ed5106870f5

The purpose of these files is to prevent anyone else having to jump through hoops to perform a fork of the software. I will be asking Andrew or perhaps yourself for similar unbranded graphics for v2.

Thank you for your concern.

Jim

did you mean to post an image?

I think I am missing some context here. The diff you link to was authored by you, not Andrew.

PS: My name is Filipe, not Felipe.

Rcomian commented 2 years ago

Apologies, Filipe, I've added your name to my dictionary accordingly.

I had a conversation with Andrew on discord about supplying unbranded module graphics explicitly for use by forks of vcv so that they didn't have to recreate all the files from scratch or risk other legal aspects of the design.

Andrew agreed and supplied the files to me by email on the 20th May 2021. The commit you reference was me applying those files to this repository.

falkTX commented 2 years ago

Ah ok, so that was the missing context, thanks for clarifying. Do you mind adding this information to the README? It is weird that the talks with Andrew are not mentioned anywhere.

Sadly looking more into this, should have noticed it earlier sorry, these new graphics are still CC-ND, so we are not allowed to make derivates. That is a real bummer... we can look at them but not touch them :disappointed:

CC-ND artwork has no place on an open-source project, but that is just my opinion I guess...

Rcomian commented 2 years ago

CC-ND-NC in fact. But at least forking and distributing rack itself is not an issue. I was going to suggest these graphics for Cardinal, but they're only v1 at the moment, I haven't asked for the v2.

Also, sorry, I assumed you were Andrew's new graphic designer doing a copyright sweep. Was pretty annoyed at that thought.
