IE 150+nodes, DnD endless refresh (not reload)

What steps will reproduce the problem?
1. Drag and Drop tree
2. 150+nodes, 3 levels deep
3. IE 8 on Win 2003 svr OR IE 9 on Windows 7

Mostly interested in if you've seen this before.  In IE, the first time I drag 
and drop any item in the tree it suddenly goes into an endless refresh loop 
(thereby making it unusuable).  Note, this is not a reload loop. Fiddler does 
not show calls going back for the latest json.

What version of the product are you using?

    $Version: 1.2.0$
    $Revision: 528, 2011-09-17 18:58:59$

On what operating system and browser?
    Tested on IE 8 on Win 2003 svr AND IE 9 on Windows 7

Please provide any additional information below.

the app is a bit complicated at this point. so I'm just looking to see if you 
have seen this before, otherwise, I'll just work on simplifying the app/context.

no, I haven't heard about this so far. Did you try other browsers?

Found the problem.  A template page was putting some text before the DTD spec.  
Getting rid of the text got rid of the problem.  wierd,but hope this post helps 
someone else in the future.  Cheers,
