Anybody have code so I can try to fix this? Or is anybody working on a fix?

I don't know if anyone's working on this from this repository but there's a guy
who forked and has released 2.0.1 which reduces flickering but isn't complete
fix. You can get the code from his git.

I'm using MenuBarFilter (which is based on code from Nocturne) and installing
gfxCardStatus from http://codykrieger.com/gfxCardStatus and setting the card
into "Discrete Only" mode helped for me and completely stopped the flickering.

Deleted my last comment. I lied I wiped Nocturne and MenuBarFilter completely
from my system and restarted. The new version that was forked is working
without issue as of right now. I'll reply later once it's been running for a
while with updates. I'm running it on a Mid 2011 Mac Mini and latest version
of Mountain Lion for anyone that cares. I'll also be updating this on a 2010
Mac Mini later today.

So I've been running this now for a about a month and the issues still aren't
fixed with the forked version. The root of the problem seems to exist somewhere
in the base of the program and the way it interacts with the OS. Still
flickers, overlays full screen apps and now it also doesn't travel out of the
first desktop if you are using multiple desktops.

Upgrading to OS X 10.8.3 seems to have fixed the problem for me finally :D I'm
running MenuBarFilter though. Haven't tested if it works in Nocturne too.

I'm gonna give it some time but so far so good with 10.8.3 I'm not running
MenuBarFilter.

It seems like the issue is still there in 10.8.3 :(

With MenuBarFilter running, it seems to be working correctly. I'll let you know
if it really does work after running for a few hours.
