I am working on creating a full program for the Heart Synth Monitor I have created and Patented. Nice try to be sneaky and basic but, this design is currently being developed by me and I don’t appreciate you not contacting me before trying to market your altered development.

I already have a working design that is being expanded on as we speak. I have a full blown project with this idea and I am not releasing any more information I have discovered for this purpose.

Hello,

Empty? I will direct you to my law firm that is working on my 20 year patent application as I am sending this email. I am working very hard to produce a very unique heart monitor that can be used for many different purposes, the main being to convert your heart rate pulse into frequencyand light wave hz. This idea is one I came up with in school this time last year and I decided to pursue. I am not giving up my information or my new found dream. I am at the point to be worried about my idea being stolen and marketed under my nose while I get my rights sorted out for property that I have claimed as my own. I am following in my grandfathers footsteps whom owns the patent to one of our nations first missiles. I am keeping my research extremely close now that I know it’s wanted by many. And I have a patent for it. I am just extending it before I put my own product on the market. Your prototype is only different in the sense that it isn’t fully developed yet. You created a pulse sensor with a code that activates a light source, but you are stealing my plans and money by advertising it in the way you are. It looks like a fantastic start up kit for other micro entity inventors to experiment with, but I patented my invention as soon as it was created to prevent this from happening so I have notified my law firm and I apologize for being so foward. Melissa,

You can get a patent on “methods and apparatus” not a patent on “ideas”.

In the US, patents generally last 20 years, correct.

If you are serious about pursuing patent-infringement, first you need a have a government patent-office award a patent to you. Easy to say, but hard to do.

Your legal team should be honest with their clients. One cannot patent something another person has already made. “Secret research” is not protected by patents.

The 3 criteria you have to meet for a patent is that it is: 1)New 2)Novel & 3)Non-obvious. We first disclosured/published the tech for our apparatus in 2011. The Apple Watch and Fitbit also use “light to detect human pulse”. The burden is on the patent applicant’s part, to prove that their art is different enough from ALL prior art. It’s a heavy burden, as you will find while writing your patent application.
