No menu button in settings on newer phones without hardware button

What steps will reproduce the problem?
1. Install software on HTC ONE
2. Go to settings - it will say select menu to add host
3. No menu button on hardware and no button in the software, no three dots

What is the expected output? What do you see instead?
Three dots or other solution to access menu

What version of XBMC Remote are you using?
1.0.9

Which Android device are you using (and which ROM, if custom)?
HTC ONE - Stock ROM - Android 4.3

Which XBMC revision are you running and on which platform?

12 Frodo on linux

Same for me with HTC One - there is no hardware menu button.
