This is technically impossible, there is a bug either in the API or in the theme submission system.

One of the two themes was actually immediately marked as "Duplicate", but for some reason its author didn't replace it.

It could be a usability issue (user didn't realize the theme was eliminated and/or could be replaced), but since we have only 2 cases in the whole DB including this one, I won't consider this an issue for now.
