GPL Violation #20

I'd like to bring your attention to the following app, which seems to be a
proprietary derivative of frozenbubbleandroid:
https://play.google.com/store/apps/details?id=us.can0p.shootdinosaureggs

Everything appears to be the same except that some graphics has been replaced
and an ad has been added. No source code is provided and neither is
acknowledgement of the original author.

This is the developer's email as shown on the app's page: 6Canopus@gmail.com

New graphics are not covered by the GPL - I sent an email to check whether
he/she modified the source code, at which point they should make it available
to comply with the GPL.

If the game is identical to Frozen Bubble for Android, but with different
graphics is all, then it's not a violation.

Note that section 3 of GPLv2 requires that the binary be accompanied with
either an offer for source code or the source code itself, even if it is
unmodified, so he/she should tell the users where to find the source code
regardless.

This is the reply I received:

Hi Eric Fortin,

I use cocos2d-x and code the game by C++ from the scratch so I think I am not
violation Frozen Bubble or GPL open source license.

Please check carefully again!

Thanks!

A rewrite is not derivative, so this is not in violation.

How about the graphics, sound effects, and level map?
