HP's lawyers provided the following feedback:

We have concerns about phrases such as "... (including relevant excerpts of the TCK, provided such TCK excerpts are inherently part of such results), but not the non-relevant portions of the TCK itself." Words such as relevant and non-relevant are open to differing interpretation, and the concept of TCK excerpts being part of the results doesn't make sense.

I believe that the intent of the "relevant excerpts of the TCK" phrase was to permit small extracts of source-code to be exchanged if necessary.

At the very least people should be able to give a classname and method if not full source for test / method in question.
