The choice of RI license will affect the possibility of a JSR being included in the Java platform. We decided to provide some non-normative guidelines on this matter in the Spec Lead Guide.

The guidelines should:

• Warn Spec Leads of their responsibility to ensure that the terms under which they accept IP grants from contributors must be sufficient to ensure that they can make the necessary grants (including patent grants) to all implementors of the JSR, including those who implement in "clean-room" fashion directly from the Spec (that is, who do not derive their implementation from the RI). ** A good way to do this is to ensure that they accept RI contributions only from those who have signed either the JSPA or the JCP's Associate Membership Agreement. Advise Spec Leads that the license they choose and the IP rights granted by whatever contribution agreement applies to those who participate in developing the RI will affect the possibility of having their JSR included in the Java platform. If this is a goal they should consult with the relevant business team in Oracle *before** selecting a license.
