The flat IP regime where the IP flows directly from the contributor to the implementer/user of the Spec clarifies the provenance of the IP when members of the JCP are engaged in litigation and need to terminate IP rights as part of that litigation. Under the current regime, if a JCP member wants to terminate their IP grants to a 3rd party litigating against them, the 3rd party can claim the IP was not received from the JCP member, but from the Spec lead. This would complicate, delay and potentially harm the JCP member in litigation. Under the flat IP regime, the JCP member who granted the IP as part of its obligations in the JCP could clearly assert their termination of the IP rights in this situation.
I will incorporate this explanation into the IP Flow document.
