Ok I found a way to make it work I do not know if this is classed as a work around or a fix but I edited config.txt on the SD card to remove the hash from the second line so that it reads
hdmi_safe=1
and it now works after a sudo halt
I only found out about the config.txt file becuse of a related issue with a user complaining about composite quality. :)
This may be a false alarm it's not playing as expected on a new image.

OK the answer was in the config.txt but it appears to be uncommenting
hdmi_force_hotplug=1
This is not uncommented in the beta but appears to solve the problem including first time boot and susequent starts after sudo halt and sudo shutdowns.
Obviously there's some underlying difference but it does get me past the problems I've had and gives me a new topic to write for the noob because I only found out about config.txt by chance.

Clean image boot first time out of the card will not see an active HDMI.
The hardware has all functioned with the beta both before and after.
It works once I choose startx and re-boot it's also ok if I use a composite cable and no HDMI. if both cables are pluged in it goes to composite.
I have 4 HDMI leads to choose from but if it was the lead I figure it would be dead for startx and re-boots and would also not work with the earlier beta image, which I have on another SD and as I have torrented twice both images both have been refreshed and still behave the same.
The new version allways fails to detect the live HDMI on start. But after a re-boot its fine until halt or a shutdown (even tried crashing out in case it was the shutdown routine).
If I re-boot once I have done a raspi-config from ssh or a composite connetion it's fine till I shut down then it goes back to a dark HDMI. Technically a blue HDMI because it's a TV and the screen is blue till it gets the signal.
Now the downloads were both clean Ktorrented off Ubuntu but the checksum for the zip was perfect for both and the unzip went ok, so I have kind of excluded this as a problem source.
The kernel must be running or I would not get ssh or the composite.
The Lead should be ok or it would fail on startx or the tests using the beta version.
Downloaded Zip version and it appeared to be the same as the Torrented ones.
Since this testing was started I have also tested on another SD card 32g
I have also managed to have an ok start using the RaspRazor image using all the same hardware.
I have even done a power crash test pulling the power (I know I should not) down to see if this was an issue with the clean shutdown however dispite this drastic action HDMI failed but ssh was fine and it again re-booted to HDMI
On the back of this I have had communication with mike Thompson and Alex (asb) on Alex's advice I followed the instructions at http://www.raspberrypi.org/phpBB3/viewtopic.php?f=66&t=12170 adding untested to the firmware update path.
apt-get update and upgrade both completed appearing to make some changes allong the way however the problem persists.
No HDMI at boot after a clean shutdown however once the RPi is running a reboot initiated over a ssh connection sees the RPi boot as expected.
I am atending a meet tomorrow (correction Saturday sorry I don't know what day it is) where there should be some other RPi's and I will update If I find anything.
