For many maps, transparency is set to 40% for the map-unit feature class. This was originally to allow topographic base maps to be visible through the semi-transparent polygon colors. However, the transparency is not represented in legend colors, regardless if the legend was generated by the Arc legend function or by the NCGMP09 toolbar legend creator. It would be useful to be able to replicate colors from the map to the legend where transparency is used. Transparency is interpreted by RGB colors as whitening, so that 100% transparency is 255, 255, 255 (white). A color that is 255, 155, 55 with 50% transparency will be interpreted as 255, 205, 155 (half way between the original color and 255).
