From a comment in the Regulation/Legislation board back in March regarding this topic: "I do not see a provision within the MHA or the MH Regulation which explicitly or indirectly exempts a notice of transfer under a court order from application of the Schedule 1 fee. In fact, MH Regulation s. 10, Transmission under court order, refers to "notice of transfer" in essentially the same way as other transfers described in MH Regulation sections 6-9 and not by using some other terminology. It is possible that there is some other provincial legislation that exempts government fees when associated with implementation of court orders, but if such provisions exist I am not aware of them. This is not to say that we must charge the fee. Only that not charging the fee appears to require a different rationale."
Based on that comment - I think we should be charging the $50 Fee, as we do not have any rationale that tells us this filing should not be in alignment with the regulation fee schedule.
Hey @cameron-eyds , I believe now we should be charging $50.00 for the Transfer due to Court Order instead of $0.00. Please take a look at the attached spreadsheet, I'll update the title it's misleading, thank you!
@chdivyareddy Hey Divya, i thought so as well and updated the UI to reflect the cost. Is there a back end component to this? Is pay-api not actually charging the 50?
@cameron-eyds Sorry, my bad...I was using previous version in DEV (40), now updated to 41 and all good 😄 🙌🏻
