Not wanted REFER on participant adding

What steps will reproduce the problem?
1.A has started a GroupChat with B and C
2.B leaves the GroupChat
3.A adds B in the GroupChat
4. B accepts

What is the expected output?

B must take part in the Conference

What do you see instead?

B sends a REFER request to the GroupChat.
The invitee are A and C
The REFER is answered with a 486 Error response because the max of participants 
in the GroupChat has been reached.
An error  pops up on B device

What version of the product are you using? On what operating system?
2.5.8
Android 2.2

This problem has been detected in version 2.5.9, on Android 4.0.4.
