In 10-20 duels as warrior against a frostmage with arctic wind 3/5 and me having 1% default miss with 80 hit raiting, i can say that talent seems to provide too much miss or you get too much miss while having 80 hitraiting in pvp. I don't know why but my recount didn't saved the data properly in duels so i can't post a screenshot which shows this issue. But i think u can easily test this issue in the server yourself.

Only spells have 1% chance to miss always, physical attacks and abilities are (at least should be) capped at 100% chance.

Not true DarkenRal. Physical attacks have 1% miss always too.

o'rly? how about no?

once you reach or surpass the hit cap, you will never miss an attack against a raid boss unless you are under the effect of some debuff that reduces your hit chance (for example, Attumen the Huntsman's curse).
