I think those lines might relate to the Paypal integration, which I originally used as the basis for this - I think I wasn't particularly sure what problem they were trying to solve, so commented them out, but if that solves your issue, am quite happy to merge that - I know Sagepay can fire notifications off at quite a rate if they don't get a response quickly enough.
At the moment the Payment Processor doesn't seem to handle SagePay sending 10 repeat notifications, 1 a second, if it doesn't get an OK response quickly enough.
I saw there was already a commented-out section which appeared to deal with this (similar to the CiviCRM Wiki page on Payment Processors) and have re-enabled.
