Enabling Automatically hide and show the menu bar on desktop
in system preferences and then restarting the spacebar service fixed it for me. Initially I had the same issue.
I'm guessing its position is only determined once at its startup. And it does make sense to have it underneath an always present menubar.

Actually the link you provided does list that option. See the last two options in the Dock & MenuBar section.

The link is for Monterey, select Mojave :)
Spacebar displays both under top menu and when a window is present (using yabai) it is also hidden underneath.
