As the system is being developed, the design should contemplate the methodology to track data and metadata measuring use of the system.
Certain information may be integral to the operation of the system. For example, there may be an essential need to identify the user to separate and secure such user's information from access by others. Such use of information should be disclosed in the terms and condtions, but use of the system may be made conditional upon the acceptance of such terms.
Access to certain information may help in identifying possible improvements to the user interface.
Information that could inform a policy process to imrpove the substantive and procedural law applied to the area of expungement could entail esssentially all information.
Every effort should be made to anonymize data that is aggregated for statistial analysis or public policy purposes. Design should also anticipate the risk of possibly tieing anonymous data back to an individual through reverse engineering of the data. As machine learning and artificial intelligence capabilities improve, the risk of such reverse engineering of the data grows.
Develop systems to track progress of users and the cost and time expenditures in processing expungements.
