As noted in issue ( https://github.com/conda-forge/cuda-nvcc-impl-feedstock/issues/21 ), CUDA 12.4.0+ have this constraint. The fix here applies to 12.5.0. Thus 12.5.1 includes it automatically

Prior versions (like 12.4.0) can be fixed with a repodata patch
