Describe the issue

According to TestV
"Verordnung zum Anspruch auf Testung in Bezug auf einen direkten Erregernachweis des Coronavirus SARS-CoV-2 (Coronavirus-Testverordnung - TestV)"
("Coronavirus-Testverordnung vom 21. September 2021 (BAnz AT 21.09.2021 V1), die zuletzt durch Artikel 1 der Verordnung vom 29. März 2022 (BAnz AT 30.03.2022 V1) geändert worden ist")

§ 19 Inkrafttreten, Außerkrafttreten

"(1) Diese Verordnung tritt am 11. Oktober 2021 in Kraft; sie tritt am 30. Juni 2022 außer Kraft."

The regulation ceases to be valid after June 30, 2022. FAQ articles which refer to this legal regulation will become incorrect on July 1, 2022.

Since this is a legal issue requiring coordination with RKI and BMG I do not plan to submit a PR. I would leave any change to be made by the Open Source Team.

@MikeMcC399 I also know about this issue but at the moment there is no information available. We will change the texts once we got more information.

@svengabr I read in Lauterbach kündigt neue Impfkampagne an 17.06.2022 11:32 Uhr:

"Lauterbach sagte, er gehe zudem davon aus, dass Bürgertests auch im Sommer weiter genutzt werden könnten. Bisher ist das Angebot für solche kostenlosen Schnelltests für alle bis Ende Juni geregelt. Lauterbach zufolge soll es daher ein neues Testkonzept geben. Die Verhandlungen für die weitere Finanzierung der Bürgertests liefen derzeit. Es müsse geklärt werden, wer die Bürgertests weiterhin bekommen solle, wie diese finanziert würden und wie verhindert werde, dass es zu Missbrauch komme. Das Konzept solle in den nächsten Tagen vorgestellt werden."

So it sounds like there might be a "last-minute" change before the current regulations run out.

Is the Open Source Team planning to prepare for the expiry of the TestV next week? For instance, I could imagine having a new branch for this purpose, to collect any PRs related to this change, which could be merged on the expiry date, similar to the way a new release is handled.

Or is there some expectation that there will be a replacement regulation available at short notice on July 1, 2022?

This is a high priority item which should be looked at ASAP and as soon as someone knows what the plan actually is this needs to be relayed here. If the TestV expires & "Bürgertests" won't be free of charge anymore, we can assume that many of the testing stations listed on https://map.schnelltestportal.de will close. This would render the map practically useless as it will list many closed testing sites.

I see you already added this as an issue to https://github.com/corona-warn-app/cwa-map-public-frontend/issues/16.

It seems now quite certain that changes to the FAQs will be needed regarding references to free-of-charge §4a "Bürgertestung".

Perhaps for the moment the best solution is to simply change "In accordance with §4a Testverordnung you are entitled to a free rapid antigen test ('Bürgertest')." and add

"until June 30, 2022"

to the sentence?

When there is a new /revised legal document available the text could be updated later or removed, whichever is most appropriate.

One more idea:

Publish a new article: "Do I have to pay for COVID-19 tests?" and then either describe there who pays and for what or refer to some other website like a BMG website which describes this in detail.

„Die Bürgertests werden aussagekräftiger und zielgenauer.“ In einer Pressekonferenz sprach Bundesgesundheitsminister Prof. Karl Lauterbach am Freitag zur neuen Testverordnung, die am 30. Juni in Kraft tritt. Er betonte, dass die Tests für vulnerable Gruppen weiterhin kostenlos blieben, im Normalfall müssten sich Bürgerinnen und Bürger künftig mit 3 € beteiligen.

This issue is resolved as far as the currently published version of TestV is concerned.

Die V tritt gem. § 19 Abs. 1 idF d. Art. 1 Nr. 8 V v. 12.11.2021 BAnz AT 12.11.2021 V1, d. Art. 2 Nr. 9 V v. 16.12.2021 BAnz AT 17.12.2021 V1 u. d. Art. 1 Nr. 9 V v. 29.3.2022 BAnz AT 30.03.2022 V1 am 30.6.2022 außer Kraft

A new issue may need to be raised when the expected new version of TestV is published, for instance under the link https://www.bundesgesundheitsministerium.de/service/gesetze-und-verordnungen/detail/coronavirus-testverordnung-testv.html or in the lists on https://www.bundesanzeiger.de/pub/de/amtlicher-teil.

https://www.bundesanzeiger.de/pub/de/amtlicher-teil shows the "Dritte Verordnung zur Änderung der Coronavirus-Testverordnung vom: 29.06.2022" published, which comes into effect tomorrow June 30, 2022.

It specifically mentions the Corona-Warn-App again which applies starting July 1, 2022.

„§ 4a Bürgertestung

(1) Folgende asymptomatische Personen haben Anspruch auf Testung mittels PoC-Antigen-Tests: ...

  1. Personen, die durch die Corona-Warn-App des Robert Koch-Instituts eine Warnung mit der Statusanzeige erhöhtes Risiko erhalten haben ... (2) Bei Testungen nach Absatz 1 Nummer 6 und 7 hat die zu testende Person einen Eigenanteil in Höhe von 3 Euro an den Leistungserbringer zu leisten. Dieser Eigenanteil kann auch von dem Land getragen werden, in dem die Testung durchgeführt wird.“
