Legal question in using CWA servers #130

I am currently working on a hardware token for the Exposure Notification API (See https://github.com/Lurkars/esp-ena). For being fully compatible with CWA, it is indispensable to download the Exposure Key export packets from official servers and also upload keys when infected.

So my question is: are there any legal issues/complains in using official CWA servers without official CWA Apps?

So far there are no official commitments by Robert Koch Institute or similar institutions that the data can be used publicly, but as long as the respective licenses (don't use the "Corona-Warn-App" trademark and respect the Apache 2 license if you use code for your product) are respected properly, we are currently working on the assumption that this is possible without problems (if you don't do any malicious activities). The endpoints are public and unrestricted anyway... We also have a pretty active community that wants to bring the app to Google-free devices, see https://github.com/corona-warn-app/cwa-app-android/issues/75 - they need that as well.

But we keep this issue open so that we can reach out to RKI and others to get an official statement on this.

Hi @SebastianWolf-SAP,

Your answer seems to contradict the Terms of Use Section 9:

You may not use the CWA Services for any purpose other than the intended use of the App on your device. You may only access the CWA Services via the App.

Please clarify.

As said, we will clarify that. The only thing we can tell you in addition to the original comment is that there are already some community projects out in the wild that are using the exact same data, such as https://micb25.github.io/dka/
