update jquery and modernizr version #5

Hey, could you please update JQuery and Modernizr to the newest version? I would do it myself but after I updated them the theme is broken... :)

I'm planning to re-develop much of the theme, and update those in the process. Just haven't had much free time to do it yet. Soon I hope.

Finally getting around to the new version and both of these have been updated.
