Title 40 Part 121 left over old sections #313

Title 40 Part 21 had some laws become effective Sept. 11. which were received on 2020-09-14 9d53f8c6.

This looks like a complete rewrite to Part 121. This includes subparts A, B, C, D, E.

It looks like OFR left behind old Subparts C and D in Part 121 when inserting new subparts

The newly inserted sections look correct, but it appears they left behind old subparts C and D, which include sections 121.21 through 121.28 (Subpart C) and also Subpart D, which is section 121.30

I believe we should create a patch that retains the new subparts and removes the previous subparts D and E.

I think new content structure should look like this according to FR Doc: https://www.federalregister.gov/documents/2020/07/13/2020-12081/clean-water-act-section-401-certification-rule#sectno-reference-121.16%20

For the reasons set forth in the preamble, EPA is revising 40 CFR part 121 as follows:
PART 121—STATE CERTIFICATION OF ACTIVITIES REQUIRING A FEDERAL LICENSE OR PERMIT

Subpart A—General
121.1Definitions.

Subpart B—Certification Procedures
121.2 When certification is required.
121.3 Scope of certification.
121.4 Pre-filing meeting request.
121.5 Certification request.
121.6 Establishing the reasonable period of time.
121.7 Action on a certification request.
121.8 Effect of denial of certification.
121.9 Waiver.
121.10 Incorporation of certification conditions into the license or permit.
121.11 Enforcement and compliance of certification conditions.

121.12 Determination of effects on neighboring jurisdictions.Start Printed Page
